Apple has embedded firmware checks to make sure the LCD serial matches the hardware, in order for True Tone to work. I requested my supplier to check that the OEM parts he is supplying has all settings that work in Big Sur and above MacOS, and they do. BUT the reason however is due to a poor quality OEM (hardware issue). You are right that a fraction of them will cause the brightness settings not to show up, on Big Sur and Monterey.
